SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. Nothing in this arbitration provision shall prevent either party from seeking emergency injunctive relief in a court of competent jurisdiction where necessary to prevent irreparable harm.

16.3 Class Action Waiver

YOU AND DEWEY'S PIZZA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and Dewey's Pizza agree otherwise, no arbitrator or judge may consolidate more than one person's claims or otherwise preside over any form of a representative or class proceeding.

16.4 Small Claims Court

Notwithstanding the above, either party may bring an individual action in small claims court in the appropriate jurisdiction, provided the dispute qualifies under the rules and limitations of such court.


17. Term and Termination

These Terms of Service shall remain in full force and effect for as long as you access or use the Website or our services. Dewey's Pizza reserves the right, in its sole and absolute discretion, to suspend or terminate your access to the Website and services at any time, with or without notice, and without liability, for any reason, including but not limited to:

  • Non-payment or initiation of fraudulent chargebacks;
